A horrified mother claims that the disturbing image that appears on cigarette packs is from her father, near death, in the hospital.
Jodi Charles is 42 years old. She saw the cigarette pack and claims to be "100% certain" that the photo shows her father, David Ross.
David died in 2015 and Jodi says it "can not" that he has given his permission to use the image.
The 66-year-old father, who worked as an ambulance driver, smoked, but died of bone marrow, sepsis and lymphoma, a type of cancer that affects the blood.
Jodi believes that someone must have taken the photo in one of the times he was hospitalized.
The photo shows an unconscious man lying on a hospital bed with a tube in his mouth to breathe.


The hospital denies the allegation, and the European Commission assures that the image is from someone else. Jodi says she's still waiting for someone to prove it.
The photo is one of the 42 terrible images used on all cigarette packs marketed in the UK. This is a law of the European Union that tries to reduce the consumption of tobacco.
Jodi is from Purfleet, Essex, England, and explained the following: "A friend of mine, who is a smoker, came to visit this week and my daughter took the cigarette pack."
"She ran to the room and said, 'Look, it's Grandpa!'"
"When I saw the picture, I said, 'Oh, my God.' I knew without a doubt that this was my father. I was horrified. "
She says that her hair and various facial features are unique to her father.
"I'm 110% sure it's him, and it's not possible that he gave his permission for a deplorable photo like this to be used. It's terrible".
She added that the text is "absolutely disgusting" because David did not have a stroke, was not disabled, and did not die from a smoking-related illness.
A spokeswoman for the European Commission said that all the people appearing on the pictures gave their consent for this, adding: "We are very sorry for the anguish caused to this woman who believes that her father is represented in this health warning."
"However, after comparing his father's information with the identity of the person in the picture, we can state categorically that the individual in the picture is not David Ross."
The university hospitals of Basildon and Thurrock also deny that the photographs are from Jodi's father.
Jodi still did not convince himself and said, "If it's not him, I want evidence, and a document signed by him giving his permission for the photo to be used."
"If you do not show me this, I will denounce you."
